According to the Personal Data Protection Law No. 6698 (“Law”), Cömertoğlu Otelcilik ve Ticaret A.Ş. (“hereinafter referred to as ‘Delphinhomes’”) is defined as the data controller due to processing your personal data. According to Article 10 of the Law titled “Obligation of the Data Controller to Inform,” data controllers are obliged to inform real persons whose personal data they process on certain matters. This text has been prepared for Delphinhomes in order to comply with the legislation and to be transparent and accountable.
Definitions
According to the Personal Data Protection Law No. 6698:
- Personal data refers to any information relating to an identified or identifiable natural person;
- Processing of personal data means any operation which is performed on personal data such as collection, recording, storage, preservation, alteration, reorganization, disclosure, transfer, takeover, making available, classification, or preventing the use thereof, fully or partially, through automatic means or otherwise, provided that they form part of a data filing system;
- Data subject refers to the natural person whose personal data is processed;
- Data controller refers to the natural or legal person who determines the purposes and means of processing personal data and is responsible for the establishment and management of the data filing system;
- Obligation to inform refers to the obligation of the data controller or the person authorized by the data controller to inform the data subjects about the identity of the data controller, the purposes for which the personal data will be processed, the persons to whom and the purposes for which the processed personal data may be transferred, the method and legal basis of collection of personal data, and other rights listed in Article 11 of the Law.

Data Controller
The data controller responsible for determining the purposes and means of processing your personal data and for establishing and managing the data filing system is [DELPHIN HOMES].
Personal Data Processed According to Processes, Processing Purposes, and Legal Grounds
- Identity (Name, Surname), Contact (Phone Number) data:
- Purpose of Processing: For conducting communication activities (receiving your information through the Request a Call form).
- Legal Ground: Article 5/1 of the Law: Your explicit consent provided through the application form.
- Purpose of Processing: For conducting storage and archiving activities.
- Legal Ground: Article 5/2(f) of the Law: Processing is necessary for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.
- Purpose of Processing: For conducting communication activities (receiving your information through the Request a Call form).
During these processes, your Contact (Phone Number) data is used with your explicit consent to communicate with you, and your transaction security (date and time of the transaction) data is created based on the necessity to process data for the establishment, exercise, or protection of a right (Article 5/2(e) of the Law) for the purpose of conducting information security processes (to record transactions).
Transfer of Personal Data
Your personal data may be transferred to relevant authorities without your explicit consent and without the obligation to inform, within the framework of Article 28/1 of the Law, upon request. Additionally, in unforeseen circumstances, your personal data may be transferred to public institutions (such as Ministries) as specified by law, within the purposes and limitations defined by law, if requested as clearly stated by law. Outside of legal obligations that do not require informing and your explicit consent, your personal data is not transferred.
Methods of Collecting Personal Data
Your personal data is obtained through automated methods when you enter your information on the Request a Call screen. Additionally, your transaction security (date and time of the transactions you perform) data is automatically generated by our site.
Your Rights Regarding Your Personal Data
Data subjects must initially convey their rights regarding their personal data to the data controller.
According to the Law, regarding your personal data, you have the right to: a) Learn whether your personal data is processed or not, b) Request information if your personal data has been processed, c) Learn the purpose of processing your personal data and whether they are used appropriately for their purpose, ç) Know the third parties to whom your personal data is transferred, domestically or abroad, d) Request the correction of your personal data if it is incomplete or incorrectly processed, e) Request the deletion or destruction of your personal data if the reasons for processing no longer exist, f) Request the notification of the operations carried out as per (d) and (e) to third parties to whom your personal data has been transferred, g) Object to the occurrence of a result against you through the analysis of your processed data exclusively by automated systems, ğ) Request compensation if you suffer damage due to the unlawful processing of your personal data.

Your application must include:
- Your name, surname, and if the application is written, your signature;
- For Turkish citizens, your T.C. identification number; if you are a foreigner, your nationality, passport number, or, if available, your identification number;
- Your residential or workplace address for notifications;
- Your email address, telephone, and fax number for notifications, if any;
- Your request’s subject.
Additionally, if applicable, any information and documents related to your request should be attached to the application.
